“Most of our clients know they have to put on their company notepaper information required by law but the new rules extend this to web sites and many emails. The Companies Act 2006 led to these changes. Now is therefore a very good time to take some legal advice on what should appear on your web site from a statutory and information point of view and how your email standard wording should be shown.
The new rules require that the following should appear:
· Full company name and Ltd or plc (not a group or division name or trading name only)
· the registered office address even if the company normally also uses a correspondence address – both can be shown as long as it is clear which is the registered office address just as is currently the law on notepaper.
· company registered number
· place of registration (e.g. registered in England)
· If one director’s name appears the others must appear too.
The Electronic Commerce Regulations already require that web sites should also show a VAT number and also any details of regulatory bodies to which a company or business is subject. Those who market goods or services on-line to consumers also need to comply with the Distance Selling Regulations which have an impact on the wording of contract terms on web sites.”
